This paper presents the concept of family and its evolution in relation to the principles applicable to family law, specifically that which refers to affectivity, as an essential foundation for the full protection of children and adolescents and for family life. This is an exploratory and descriptive research, based on a review of the relevant literature on the subject and on the laws that support the civil liability institute. The general objective of this research was to analyze the possibility of civil liability in cases of emotional abandonment of children and adolescents, disregarding the principles of the child's best interest and their dignity as a developing person, especially when affected by psychological damage. The specific objectives defined are aimed at identifying the rights of children and adolescents, as subjects of rights, ensuring their full development; know the duties of those who hold family power; conceptualize affective abandonment, its characteristics and specificities; understand the situations of civil liability arising from emotional abandonment practices. It was concluded that the parents are the main responsible for the protection and support of their children, being, therefore, holders of civil responsibility in the family law, and therefore, they should be held responsible for the emotional abandonment and obliged to compensate the victimized children.
