The present investigation aims to understand the situation of pregnant and lactating
women deprived of liberty and their babies from Ceará, based on the data disclosed in
the 2018 Statistical Report prepared by the National Council of Justice and the daily
reality of the Prison Unit Auro Moura Costa, located in Fortaleza- EC. The
methodological paths of the study, at first, turned to the understanding of the reality of
women deprived of liberty and their incarcerated babies, based on the research carried
out by the complete Statistical Report (2018) (BRASIL, 2018) and, later on. , data were
collected from a Public Defender with experience and knowledge about the dynamics
of incarceration of women detainees in the aforementioned prison unit, through a
structured interview. Data were interpreted in light of documents, legislation and
literature on the subject. The findings revealed the harsh reality of mothers and babies
in that prison, which translates into a humanized space, but which reveals the
inadequate reality for mothers and their children, who are subjects of fundamental
rights and guarantees, to be there. The rights to health, food, housing, leisure and
others cannot be enjoyed by incarcerated mothers and their babies in that space of
restrictions and impossibilities. Breastfeeding is highlighted – the right of women and
children, notably -; the right to integral development, which presupposes movement,
play, adequate stimuli, as rights that cannot be experienced in that prison environment.
Therefore, it is necessary that the criminal execution policies of women consider the
reality of house arrest for women mothers in prison, asserting the rights of these
women and their children.
