The objective of this monograph is to analyze civil liability due to emotional
abandonment, considering the legal value of affection in family relationships and the
absence of norms that treat paternal omission to the duty of care as a civil offense.
Initially, the study will focus on family relationships and their evolution, going through
the paternal affection and its absence, ending with civil liability and reparation of the
damage caused, taking into account the current jurisdiction, doctrines and their
applicability.
This study will analyze the concept of family, the evolution of family power, the bases
applied to family law, dealing with civil liability and its daydreams.
The affective abandonment and its consequences for the child or adolescent will be
clarified here, as well as the moral damage and, finally, it will deal with the
applicability of compensation for moral damages as a result of affective
abandonment, given the contradictions of jurisprudential positions and in the doctrine
today. .
