O porte e a posse de armas: a análise da flexibilização na legislação e sua repercussão.
Resumo
Firearms have an extensive history in Brazilian society, with the 2003 Disarmament Statute being one of its major milestones in legislation, which even inspired the parameter in several other places. In the current period, guns are constantly associated with an effective method of self-protection for the good citizen, however, they are also linked to criminality, therefore, in any case, they are related to security. Putting the question in this way, it is necessary to say that it is necessary to fully observe the scenario to understand the reason for the differences on this issue, since part of society defends a reduction in bureaucracy for the acquisition of the weapon and there are those who support the thesis of strict control over the circulation of firearms and their accessories in the country. In this sense, it must be said that the current president of the republic carried out a broad flexibility in the rules that deal with this issue, through presidential decrees and, in view of this, a debate was raised in society on the constitutionality of the content of these presidential acts and their contrary to the guidelines established by the Disarmament Statute. Given the above, this research aims to analyze the central points of the presidential decrees that presented the controversies and to consider the repercussion of this broad flexibility in Brazilian society, thus, observing the history of the trajectory of weapons in the country and the importance control of weapons and accessories.
