A adoção internacional no Brasil e o impacto do excesso de burocratização.
Resumo
In Brazil, due to the excessive bureaucratization on intercountry adoption, there are
many impacts on Brazilian children that have no rights on assisted family living.
Therefore, is noticeable the occurrence of profound incongruity in relation to the
exceptionality of intercountry adoption, and the State must guarantee that every child
has a familiar living, based on the article 227 of the Constitution. The job of this
research turns relevant in the sense that it seeks to highlight the impacts that the
excessive bureaucratization of international adoption has generated in Brazil. Thus,
the main goal of this paper is to accurately analyze the impacts of bureaucratization
on international adoption in Brazil. This work also has the scope of studying the
principle of the best interests of the child, excessively bureaucratic measures,
trafficking and international kidnapping of children. The methodology used in this
article is bibliographical, with a reference based on books, articles and legal
magazines. Therefore, a research with a basic strategic purpose is made, with a
descriptive objective, using the inductive method, with a bibliographic procedure.
Lastly, the contribution of this research aims to review the processes of international
adoption, due to the many children who are left on the sidelines by the State, and it
also aims to have greater accountability of individuals who violate the rights of these
children, but without the need to bureaucratize excessively.
