We will analyze the slowness in the adoption process, it is intended to show the
bureaucracy and delay in the adoption processes during the pandemic period in Fortaleza, Ceará
state. The concept, legal nature, the background to the adoption, the current approach, the
requirements, the effects and the issue of delay in the adoption process and procedural speed.
Point out the reasons that lead to delay and slowness in the adoption process.
It will be addressed about the expectations of adoptees, showing that children are
anxious to have a family but, unfortunately, most of the time, they cause them a lot of pain, as
these processes last for years of exhaustion, and with the COVID-19 pandemic unfortunately
oa delay has increased, we will see the possibilities where measures should be prioritized that
benefit both the families and children who hope to end this procedure quickly, as well as for the
court, which sometimes wastes too much time with these processes, becoming totally
overloaded, present issues relating to the Statute of the Child and Adolescent, Federal Law No.
12.010/2009, which amended the Statute of the Child and Adolescent, explaining that adoption
is a way of inserting a child or adolescent into the foster family a which is conferred the status
of son.
Within this logic, the ECA is responsible for establishing the basic rights of children
and adolescents, showing the right to be within the family, raised and educated, and exclusively
within an alternate family that ensures coexistence within this space. Emphasize that the lack
of material resources cannot be a reason for the loss or suspension of power that the family
exercises. Based on the Federal Constitution of 1988, as it was where it established fundamental
rights for children and adolescents, giving them all the guarantees and priorities necessary for
those who are still developing, determining full protection, reporting on shelters/home from
host.
From this perspective, the data collected show that the pandemic is a factor of risks
and vulnerabilities for the Adoption process in the state of Ceará, being one of the main factors
that directly implies the drop in the adoption processes completed in this period. Also through
the results obtained, they emphasize that the pandemic contributed to make it difficult to carry
out visits to shelters and to request a period of knowledge to possible adopters.
Another result obtained concerns the increased demand for people interested in adopting during
the context of the Covid-19 crisis, that is, in addition to the risk of aggression, the female
population is also at risk of being murdered, in this sense, the pandemic of Covid-19 aggravated
inequalities, risks and vulnerabilities for women, making it essential to consider racial,
geographic and social class lines, to understand who are the main victims and what are the main
inequalities that permeate this issue.
Answering like this: What are the factors that contribute to an increase in the waiting
period in the adoption process? What are the main reasons why the numbers of children and
adolescents in shelters/care homes have increased so much during the pandemic? And what
social impacts did Covid-19 have on the adoption process in Fortaleza? And finally, reporting
on adoption statistics in the state of Ceará, making a comparison in the era before the pandemic
and during the Covid-19 pandemic. Obtaining data from the State Court of Justice (TJCE).
