A aplicação dos princípios administrativos da legalidade, da publicidade, e da eficiência na tecnologia utilizada na administração pública: uma análise do big data implementado pela secretaria da segurança pública e defesa social do estado do ceará.
Resumo
This work intends to understand how the administrative principles of legality, publicity and efficiency are applied in the processes of development, implementation, maintenance and use of data technology applied in Ceará Public Administration, especially in Big Data used by the Secretariat of Public Security and Social Defense of the State of Ceará (SSPDS/CE). The nature of the research is empirical, focused on a qualitative approach, whose data collection and analysis took place through the interview technique with the agents responsible for Big Data at SSPDS/CE. The first part of the work is concerned with verifying the development of Public Administration in the context of the 1988 Constitution, including addressing the currently adopted administration model, namely, managerialism. Furthermore, the presence of technologies that improve routine and public decision-making will be discussed. The second part of the work addresses the role of principles in the Brazilian legal system, directing the study to administrative principles as benchmarks of public service. The third part of the work proposes to analyze the application of administrative principles in the context of Big Data of SSPDS/CE, taking into account the creation and implementation of the technology itself, the overview of those responsible for Big Data about this data technology, and the possible observance of the administrative principles of legality, publicity and efficiency in this context. The hypothesis raised in this work is that although the principles are not an immediately highlighted and discussed agenda, there is some level of application. The elaboration and development of this work is justified since the present study of data technology is justified (especially the one that deals with the use of complex algorithms) has proved to be a reality for all areas, including for Public Administration. Thus, considering that the Public Administration must observe the administrative principles provided for in the Federal Constitution, there is a need to understand how these principles of legality, publicity and efficiency are applied with the data technology used by the Public Administration. Furthermore, the empirical character of this work contributes to the institutionalization of this type of research in the area of Law.
