Abstract

This work undertakes to investigate the contours of civil liability, with the aim of analyzing the figure of indemnities arising from punitive moral damages, as a form of nudge in the Brazilian legal context. To this end, the present study will permeate three main focal points: the delimitation and developments of the Civil Liability institute, the understanding of the nudge technique from the Behavioral Economy and, finally, the examination of the (in)compatibility of Punitive Moral Damage with the Brazilian legal system.
