Os psicopatas homicidas aos olhos da legislação penal brasileira: falhas e lacunas no ordenamento jurídico patrio ao tratar os assassinos em série.
Resumo
The condition of the individual psychopath is still a very complex condition for
psychologists, psychiatrists and jurists who are dedicated to the study of forensic
psychiatry. The psychopathic individual does not have a pathology, but an antisocial
personality disorder, which occurs due to a deformity in the limbic system. Because
of this deformation, the psychopath becomes a completely apathetic person, cruel,
disingenuous and incapable of learning from his mistakes and from the punishments
that are applied to him. Due to the inability of psychopaths to learn from the
punishments imposed on them, the sanctions provided for in Brazilian criminal law
are ineffective in punishing and re-educating homicidal psychopaths. Therefore, for
them to have the proper punishment, it is necessary to reform the Brazilian Penal
Code, in order to pay more attention to homicidal psychopaths and treat them with
the specificity they deserve.
