Os desafios da alienação parental para os responsáveis na guarda compartilhada.
Resumo
The present work of completion of course aims to bring up a problem that plagues part
of family conflicts in the context of disruption of the family group, the so-called parental
alienation syndrome defined by the American psychiatrist Richard Gardner, as a
childhood disorder that would affect children and adolescents involved in custody
disputes between parents. In the author's view, the syndrome develops from
programming or brainwashing performed by a parent, named as alienator, in order for
the child to reject the other responsible. In Brazil, after a quick process in the
Legislature, in August 2010, the regulation on parental alienation was sanctioned, due
to the repeated practice of these acts that were and have been used by the guardians
of the child or adolescents, which provides for sanctions on the parent cause
impediments to the child's living with the other responsible. As a result, Law n°12.318
/ 2010 was introduced as an attempt to inhibit or mitigate its effects, which will also be
analyzed in this work. Thus, the main scope of the research is the analysis of Parental
Alienation, approaching a legal perspective, analyzing its characteristics, the
appropriate means for its fight through the Judiciary and examining in the light of the
knowledge of the Law the arguments related to this area, which justified the
explanatory statement of the bill on parental alienation and the importance of Law No.
12,318 / 2010 as a means to inhibit such practice. That said, what is intended to be
done through the respective research is to present the study materials with
bibliographic sources that record the current systematic of the object of work and aims
at approaching the most varied points that involve the theme.
