A imputabilidade penal dos psicopatas na Justiça Brasileira: a imputabilidade penal

Abstract

Clarifying relevant concepts on the theme “The criminal imputability of psychopaths in Brazilian justice” is extremely important, as this research demonstrates. Almost daily, various barbaric crimes, murders, rapes appear in the media, which, due to their modus operandi, bring disgust and strangeness to society. These crimes are often so horrible that it is even difficult to imagine that they were committed by someone who is in their right mind. What is sought with this work is to analyze the psychopathic individual, his characteristics, conceptualizing imputability, semiimputability from the perspective of Brazilian Criminal Law, classifying these individuals within the merit of guilt, determining what would be the penalty that would best suit this individual, following the Brazilian Penal Code, presenting a satisfactory solution for the placement of the psychopath in the prison system. As for the methodological aspects, the hypotheses are investigated using bibliographic research. This monographic study is initially carried out on the history of psychopathy with a brief analysis of crime, and its theories in order to understand how its institutes can be applied to psychopathic individuals, with a greater focus on criminal liability and how it acts on the psychopathic personality.
